Your own PIP is first used to pay these expenses. If the other driver was found to be at fault for the accident, you can state a claim against that driver's liability coverage.

The $40,000 minimum for PIP is available to everyone injured in an accident, with half to be used for medical expenses and the other half to be used for those expenses non-medical in nature.
